Regulations of the akimat of Kyzylorda region

 

1. General Provisions

1. The Akimat of Kyzylorda region (hereinafter - the akimat) - a collegial body that is part of the unified system of executive bodies of the Republic of Kazakhstan, ensures the implementation of a national policy of the executive power in combination with the interests and needs of the development of the territory of  Kyzylorda region.

2. The Akimat is headed by akim of the region.

3. The akim of the region is formed by akim of the region from the deputy akim, the head of the region akim's administration, the first heads of the executive bodies financed from the regional budget and coordinated by the decision of the session of the regional maslikhat.

4. The activity of the akimat is regulated by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan of 23 January, 2001 "On local government administration and self-government in the Republic of Kazakhstan", other normative legal acts of the Republic of Kazakhstan and this Regulation.

5. Information and analytical, organizational, legal, documentary and other support for the activities of the akimat and akim of the region is provided by the region akim`s the administration (hereinafter - the administration).

6. The organization and maintenance of secret and unclassified records management, reception, processing and distribution of correspondence addressed to the akimat or akim of the region, including messages received via various communication channels and data transfer, is assigned to the apparatus and is carried out in accordance with the requirements of the Law of the Republic of Kazakhstan from 27 November, 2000 "On Administrative Procedures", other normative legal acts of the Republic of Kazakhstan.

7. The deputies of the akim and the head of the staff shall ensure compliance with the procedure for passing the drafts of acts submitted to the akimat and akim of the region for compliance with the procedures specified in these Regulations.

 

2. Work planning

8. Issues for consideration at the meetings of the akimat of the region shall be made, based on its authority determined by law.

9. The quarterly list of issues to be considered at the meetings of the akimat is drawn up by the apparatus on the proposals of the members of the akimat, heads of executive bodies financed from the regional budget, territorial subdivisions of the central executive bodies, akims of the districts and Kyzylorda city, structural divisions of the apparatus until the beginning of the next quarter.

The list of issues to be considered at the meetings of the akimat is approved by the akim's order on the recommendation of the first deputy akim of the region.

The approved list is sent to the members of the akimat, akims of the districts and Kyzylorda city, heads of the structural subdivisions of the administration, if necessary, to the heads of other state bodies or other organizations, as directed by the head of the apparatus.

The decision on the removal from consideration of the planned issue from the list or postponement of its consideration for a different period shall be made by the akim at the proposal of the head of the administration, agreed with the first deputy akim of the region on the basis of a written appeal addressed to the region akim signed by the first head of the state body responsible for preparing the matter and introduced not later than 5 calendar days before the date of the meeting of the akimat. The state bodies concerned are informed of this decision.

 

3. The order of preparation and holding of meetings of the akimat

10. Meetings of the akimat are held in accordance with the quarterly lists of issues or as necessary, but at least once a month and convened by the akim.

11. The akim presides at the meetings of the akimat, and in his absence - the deputy, replacing the akim in accordance with the distribution of duties established by the region akim.

12. Meetings of the akimat are, as a rule, open and conducted in the state and (or) Russian languages.

If necessary, closed meetings can be held.

13. A meeting of the akimat is considered eligible if at least two-thirds of the akimat members take part in it. Members of the akimat participate in meetings without the right to change. Based on the results of consideration of issues at the meeting of the akimat, resolutions are adopted. Resolutions are adopted by a majority of votes of the present members of the akimat, and if the votes are equal, the voice of the presiding officer is decisive.

14. Deputies of the Parliament of the Republic of Kazakhstan and maslikhat, heads of departments financed from the local budget, akims of districts and Kyzylorda city, as well as with the right of deliberative vote, heads of territorial divisions of central executive bodies, heads of other state bodies and organizations, heads of structural units of the apparatus, employees of the apparatus and other officials.

The list of the invited to the akimat's meetings, upon agreement with the head of the akim's administration, is signed by the deputy head of the administration. Closed meetings and discussion of secret issues are conducted in compliance with the requirements of the secret regime and restriction of access to meetings.

Proposals for determining or clarifying the list of invited to the meetings of the akimat on the issues discussed are made by the body responsible for preparing the issues no later than 5 calendar days prior to the meeting.

15. Preparation by the staff and executive bodies of issues for consideration at a meeting of the akimat is carried out with the following requirements:

references, analytical materials, draft resolutions submitted to the meeting of the akimat, are preliminary identified by the first head of the body that drafted the project, or by the person who replaces it, as well as by the responsible official of the instrument making the document;

the draft and the certificate should not usually exceed 5 pages of text, except for exceptional cases agreed with the head of the regional akim's administration printed in one interval (for texts in the state and Russian languages, 14 Times New Roman is used), on ordinary sheets of A 4 paper;

the project and the reference for each question should have identical headings and exhaustively reflect the essence of the matter;

Materials supplemented to the meeting of the akimat are supplemented, if necessary, with additional information;

the definition and clarification of the list of invited to the meetings on the issues under discussion, as well as their turnout is carried out by the body or by the responsible official of the administration that is submitting the question. The attendance of permanent guests is provided by the administration;

The draft protocol decision should include not more than 5 pages of information, comparative tables, slides, information (analytical) and other materials. The project is printed in one interval (for texts in the state and Russian languages ​​14 Times New Roman is used) on ordinary sheets of A4 format.

16. The administration prepares the draft agenda of the meeting and, after agreeing with the akim or the person replacing it, sends it and relevant materials to the members of the akimat and, if necessary, other officials, three days before the meeting, according to the mailing list approved by the head of the staff.

The executive body submitting the issue for consideration at the meeting of the akimat submits materials to the department of documentation support and control of the akim's administration for 5 calendar days prior to the meeting.

The department of organizational and inspection work and regional development of the region akim`s administration and the relevant department of the administartion in order to prepare additional expert materials (on the proposal of theregion akim, the first deputy akim of the region or the head of the akim's administration) on the issues submitted for consideration at the meeting may conduct the audit. Prepared materials are communicated to the members of the akimat on the day of the meeting.

In case of late submission by the relevant authorities, responsible officials of the staff of the materials, the head of the administration shall report this to the akim or the person replacing him. Responsibility for late submission of materials is assigned to the first heads of the relevant bodies.

When conducting a meeting of the akimat on the instructions of the Akim or his substitute person in urgent order, materials on the issues under consideration may be entered into the administrationon the day of its holding and be brought to the participants of the akimat's meeting directly at the meeting.

17. At the meeting of the akimat, a protocol is kept, indicating the officials present, the names and subject matter of the issues under discussion, speakers and speakers in the discussion, the main content of their speeches, comments, and decisions taken by the akimat members. The minutes are drawn up within a week from the day of the meeting of the akimat by the department of documentary support and control of the administartion, it is visited by the head of the administartion and signed by the chairperson of the meeting.

As a rule, sound recording of meetings of the akimat with subsequent decoding of phonograms and their printout is conducted. If necessary, on the instructions of the head of the administartion, a videotape of the meeting can be kept. Those present at the meeting must keep a record of data to their address or to the bodies (organizations) that they submit instructions and the deadlines for their execution.

18. Each protocol of the akimat's meetings is sequentially assigned a serial number from the beginning of the calendar year. After signing the protocol or extracts from them, the members of the akimat are sent out to the members of the akimat and, if necessary, to other officials who are given corresponding instructions at the meeting. The list of protocols (extracts) is compiled by the state body or the responsible official of the administration that is submitting the question.

4. The order of preparation and registration by state bodies of draft decisions of the akimat, decisions and orders of akim of the region

19. The executive bodies financed from the regional budget, on issues within their competence, take decisions independently. On issues within the competence of several executive bodies, joint decisions are made, which are formalized by joint orders or other acts.

20. Proposals to the akimat or akim of the region for making an appropriate decision are made by the executive bodies in the following cases:

1) when the solution of the issue falls within the competence of the akimat or akim of the region;

2) in case of disagreements between local executive bodies;

3) when the issue requires coordination of the activities of local executive bodies and territorial divisions of central executive bodies.

21. The preparation of draft resolutions of the akimat, decisions and orders of the akim of the region (hereinafter referred to as projects) by state bodies is carried out on the basis of and in compliance with the Constitution of the Republic of Kazakhstan, laws, acts of the President and the Government of the Republic of Kazakhstan and other normative legal acts.

Preparation of draft decrees of the akim of the region is carried out to resolve issues of administrative, administrative, operational and individual character.

Preparation of draft resolutions of the akimat and decisions of the akim of the region by state bodies is carried out in the state language with the provision of translation into Russian with observance of the requirements of the laws of the Republic of Kazakhstan "On normative legal acts", "On languages ​​in the Republic of Kazakhstan", other normative legal acts and this Regulation.

Orders of the region akim are developed and adopted in the state language, if necessary, their development can be conducted in Russian.

The draft resolutions of the akimat and the decisions of the region akim are submitted in the state language with an annex in Russian, coordinated with the interested bodies, endorsed by the first leaders or persons substituting them.

If there is an agreement "with comments", a reference is attached to the project with the necessary explanations on the disagreements, signed by the first director or the person replacing it.

If there is any disagreement between the bodies participating in the development of the project, the deputy akim of the region, whose competence is the subject of the issues under consideration, or meetings may be convened by the head of the administration, the results of which are documented by the protocols.

In case of elimination of disagreements, the relevant body shall finalize the project in due time and submit it for signature. In case of failure to reach agreement on the issue under discussion, the deputy akim, the head of the administration informs the akim or the person replacing him, for making a final decision.

22. Personal responsibility for the compliance of the draft Development Strategy of Kazakhstan to 2030, other program documents, regulatory legal acts of the Republic of Kazakhstan, the requirements of records management and legal technology, their timely, quality development and submission to the akimat on time, as well as for the authenticity of the project texts on state and Russian languages ​​is borne by the first head of the body (the person who is officially responsible for fulfilling the duties of the first leader) development.

23. Projects are compulsorily agreed upon:

1) with the executive bodies, which are interested due to their competence, and such interest in the project agreement is established based on the subject of the issues under consideration, and also if the project has assignments to state bodies or their managers;

2) with the management of the economy and budget planning of Kyzylorda region - on issues of economic feasibility and ensuring the project's compliance with the main directions of state social and economic policy, and also in the budget planning - on the financial security of the project.

In the event that the project affects the interests of private business entities, expert opinions of accredited associations of private entrepreneurs are attached to it, the sectoral interests of which are directly affected by the project.

24. The developer of the project simultaneously in the draft provides for the norms on bringing the previously adopted resolutions of the akimat and decisions of the region akim in line with the project, if such necessity arises after its adoption.

A comparative table is attached to the draft, providing for the introduction of amendments and / or additions to the current acts, in accordance with Annex 1 to these Regulations, politically initialed and signed by the head of the state development agency;

The project developer is accompanied by an explanatory note on the form according to Annex 2 to this Regulation, politically initialed and signed by the head of the state development agency;

If the draft acts are normative and / or affect socio-economic issues, the developer in the explanatory note is obliged to indicate specific goals, the time frame for the expected results and the expected effectiveness of the proposals being made. In the event that the akimat or akim adopts these acts, the developer, upon the results of their implementation, should submit a short report in accordance with the deadlines set in the acts.

Draft acts and appendices to the projects should be politely initialed by the head of the state body (the person officially assigned to perform the duties of the first leader), the project developer and the responsible official of the apparatus.

25. Before registration in the device, the project is checked for compliance with the requirements of the office work by the Documentation Support and Control Department of the administration. If there are any comments on the discrepancy of the project with the requirements of record keeping, the department of documentation support and control of the device before the registration of the project has the right to return it to the developer.

After registration in the documentation department of the administration, the project (with the relevant materials to it) is examined. The general term of the examination by the expert group, the composition of which is approved by the order of the head of the administrtaion, should not exceed 3 working days. After passing the expertise, the project is sent for agreement to the members of the akimat.

Expertise is carried out to assess the quality of preparation, validity, timeliness of the project, identify possible negative consequences, and also for compliance of the project with normative legal acts of a higher level, the President and the Government of the Republic of Kazakhstan, other normative legal acts and the authenticity of the project texts in the state and Russian languages. The results of the examination of projects are informational and recommendatory for the region akim, its deputies, the head of the staff when they make decisions on signing or agreeing on relevant projects.

26. The administartion during the examination or its results is entitled to return the project to the developer for revision on the grounds:

1) revealing inconsistency with its normative legal acts of a higher level;

2) identification of unauthenticity of the project texts in the state and Russian languages;

3) revealing violations of the requirements of the Instruction on record keeping in the administration, Decree No. 773 of the Government of the Republic of Kazakhstan dated August 16, 2006 "On certain issues related to registration and approval of drafts of subordinate regulatory legal acts" and this Regulation.

In case of disagreements between experts, if necessary, the head of the regional akim's administration urgently convenes an expert group meeting at which disputable issues will be discussed, the results of which are documented by the protocol.

Negative expert opinion on other grounds can not serve as a basis for the return of the project.

27. The projects are coordinated by deputy akims in accordance with the distribution of responsibilities. In case of any comments of a content character, the akim's deputies, if necessary, convene a meeting, the results of which are formalized in a protocol.

After passing the examination in the apparatus and approval from the members of the akimat, the project is being directed by the head of the administration and given to the akim or to the person substituting for the signature.

28. Resolutions of the akimat, decisions and orders of the region akim are signed by the region akim, or by a person who replaces him. It is excluded that corrections are made to the original documents after they are signed.

29. Each adopted act of akimat and the region akim by the department of documentary support and control of the administartion is sequentially assigned registration numbers for the period of activity of the region akim.

Certified copies of resolutions of the akimat, decisions and orders of the region akim are sent out by the department of documentary support and control in accordance with the list of mailings compiled by the responsible official of the akim's administration in agreement with the state agency-developer. The developer of the project must ensure its authenticity on paper and electronic media.

Acts of akimat and akim of the region, subject to registration in the justice bodies, are sent to addressees after registration. Responsibility for the timely issuance and distribution of documents is the apparatus.

Originals of resolutions of the akimat, decisions, orders of the region akim are kept in the department of documentation support and control of the akim`s administartion.

30. Acts of akimat and (or) akim, which are generally binding for citizens' rights, freedoms and duties, are subject to state registration by the territorial bodies of the Ministry of Justice of the Republic of Kazakhstan and mandatory official publication in newspapers and other periodicals determined by local executive bodies.

31. The direction of the acts for publication is carried out by the apparatus.

32. Accounting, systematization and control over the adopted acts of the akimat and akim, as well as introduction of amendments and additions to the acting acts of the akimat and akim are carried out by the responsible official of the apparatus together with the state body - developer of acts of akimat and akim (changes in the current legislation of the Republic of Kazakhstan, changing the official name of the state body, changing the heads of state bodies, as well as the composition of the existing commissions).

33. Replacement of previously circulated copies of resolutions of the akimat, decisions, orders of the akim of the region with technical errors can be made only with the permission of the head of the apparatus. In this case, the originally sent documents must be withdrawn to the device.

34. Granting access to interested persons for familiarization with the regulatory acts adopted by the akimat and akim, except those containing state secrets or a secret protected by law, is mandatory and carried out by the administration in the manner determined by the head of the administration.

4-1. The order of monitoring of normative legal decrees of the President of the Republic of Kazakhstan

34-1. Monitoring of akimat and akim's acts is carried out to identify inconsistent laws of the Republic of Kazakhstan and obsolete legal norms, assessing the effectiveness of their implementation and timely taking measures to amend and / or additions or to recognize them as invalid.

34-2. Monitoring of akimat and akim of the region is carried out on a permanent basis by state bodies, which are their developers.

34-3. Until the 30th day of the last month of the first half of the year, state bodies send information about the results of monitoring to the administration and, if necessary, proposals for making changes and / or additions to the relevant edicts or recognizing them as invalid.

5. Organization of interaction of local executive bodies in the process of consideration of acts of prosecutorial response

6. The order of control and organization of execution of legislative acts, acts and instructions of the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan, the akimat of the region and the region akim

38. The organization of execution of acts of the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan, the akimat and akim of the region, as well as documents with instructions of the President of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan, his deputies, heads of the Administration of the President of the Republic of Kazakhstan, -Minister of the Republic of Kazakhstan, central ministries and departments, akim of the region, his deputies, the head of the administartion is carried out in accordance with the Law of the Republic of Poland Kazakhstan dated November 27, 2000 "On Administrative Procedures", Presidential Decree No. 766 of April 27, 2010 "On Approval of the Rules for Preparation, Approval, Submission of Acts and Orders of the President of the Republic of Kazakhstan for Signing Projects, Controlling the Performance of Acts and Instructions President of the Republic of Kazakhstan and monitoring of regulatory legal decrees of the President of the Republic of Kazakhstan, other legislation of the Republic of Kazakhstan and this Regulation.

Control over the execution of these documents, systematic information about the progress of their execution by the region akim and the head of the administration is carried out by the administration.

39. The organization of the implementation of acts and orders of higher authorities, decisions of the akimat, decisions, orders and instructions of the region akim is to develop and adopt organizational measures by the state bodies and subdivisions of the staff for timely and exhaustive execution of them.

If necessary, to ensure the implementation of the control act of the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan, akimat and akim of the region, the state body and the structural subdivision of the apparatus shall develop and approve a plan of organizational measures for its implementation, which is brought to the immediate performers.

Preparation of analytical data on the implementation of the plan of activities resulting from the President's Address to the people of Kazakhstan and information on the fulfillment of instructions received from higher authorities (open a funded file on the progress of the protocol assignments of meetings with the participation of the President of the Republic of Kazakhstan, Prime Minister of the RK, instructions of the Head of the Presidential Administration RK and the Head of the Chancellery of the Prime Minister of the Republic of Kazakhstan) and a quarterly presentation to the region akim is carried out by the department of organizational and inspection work and regionally of development.

40. The control is carried out by:

1) demanding the necessary information;

2) hearing and discussing reports and performance reports:

3) audit and other forms of documentary verification;

4) field visits;

5) other, not contradictory to the law ways.

The control is carried out on the subject:

1) the conformity of the activities of state bodies and officials with the tasks assigned to them;

2) timeliness and completeness of execution;

3) compliance with the requirements of the law in the performance.

41. The following documents, including secret ones, are taken for control (hereinafter referred to as control documents):

1) legislative acts, acts of the President of the Republic of Kazakhstan, resolutions of the Government of the Republic of Kazakhstan, minutes of meetings of the Government of the Republic of Kazakhstan, orders of the Prime Minister of the Republic of Kazakhstan, in which instructions are given to local executive bodies;

2) instructions (including those contained in the minutes of meetings and action plans) of the President of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan, his deputies, the administration of the Presidential Administration and the Office of the Prime Minister of the Republic of Kazakhstan, central ministries and departments to local executive bodies, the terms of execution or there are instructions for taking control, marking "urgently", "reporting", "making proposals", as well as instructions, the content of which implies the need to put them on but control;

3) requests of deputies of the Parliament, regional maslikhat;

4) decisions of the akimat, decisions and orders of the akim, in which there are instructions to the state bodies and organizations of the region, as well as instructions from the region akim, his deputies, the head of the administartion, indicating the specific terms of execution.

42. Responsibility for timely and qualitative execution of legislative acts, acts and instructions of the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan, the leadership of the Administration of the President of the Republic of Kazakhstan, the Office of the Prime Minister of the Republic of Kazakhstan, the central ministries and departments, akimat and the region akim , his deputies, the head of the administration is entrusted to the first leaders of state bodies.

43. Coordination of work on control over the unconditional execution of control documents of higher authorities, akimat and akim's acts of the region, instructions of the region akim, data at meetings and meetings, all state bodies and regional officials are carried out by the head of the administration, and direct control by the relevant departments and responsible officials faces of the administartion.

44. The department for documentary support and control of the apparatus carries out control over the terms of execution of documents of higher bodies, acts of akimat and the region akim, instructions of the region akim.

Control orders of the President of the Republic of Kazakhstan and the administration of the Presidential Administration with resolutions to them by the Prime Minister of the Republic of Kazakhstan, his deputies and the head of the Chancellery, unless otherwise specified in instructions, are carried out no later than 20 days after the President of the Republic of Kazakhstan and / or the Administration of the Presidential Administration.

45. The execution of instructions given to several executors is coordinated by the official indicated in the instruction first. State bodies - co-executors of instructions submit their proposals to the body that is carrying out the set of proposals, no later than 2 days before the expiration of the deadline set for it. At the same time, assignments of the oblast akim marked "URGENT" and "ACCELERATE" are executed within 3 working days.

 Structural subdivisions of the staff - co-executors of instructions submit their proposals to the unit implementing the code, not later than one day prior to the expiry of the deadline for execution of the instruction.

46. ​​In case of need of additional time for execution of the instruction, the executor shall write to the official who gave the instruction in writing to extend the term of execution of the instruction. The additional deadline for the execution of the instruction is established by the manager who gave the commission.

47. A funded file is created for controlled legislative acts, acts of the President of the Republic of Kazakhstan, the Government and the Prime Minister of the Republic of Kazakhstan, akimat and akim of the region, where all materials on the implementation of the act are concentrated (a copy of the act, organizational arrangements for its implementation, instructions of the management, results checks, requests and information, other documents).

48. State bodies, officials of the staff responsible for the implementation of control documents, report on the implementation of each control document or its specific items in accordance with the established deadlines. The reports must contain:

1) or a request to extend the term of execution, indicating a new specific deadline, if the order can not be fulfilled within the prescribed period for objective reasons;

2) or a request for removal from control, if the instruction is executed in full;

3) or a record that the document is entered in the order of information, if the relevant act or instruction provides for the provision of periodic information.

49. The basis for the removal of control orders from the control, which envisages the introduction of draft resolutions of the akimat, decisions, orders of the region akim is the adoption of appropriate resolutions of the akimat, decisions, orders of the akim.

50. Executed documents are removed from control by the official who gave the instruction, or by another authorized official.

51. The head of the administration informs the region akim on the status of the performing discipline on a monthly basis.

Department of Documentation and Control once in two weeks provides the head of the administration with information and analytical information on the progress of control documents of higher authorities, akimat and akim of the region, instructions of akim of the region.

52. The state bodies responsible for the implementation of control documents, including secret documents, to the akim's administration prior to the 1st day of the month following the reporting month shall provide information on the status of the performance discipline and the measures taken to bring to justice the guilty officials for violating the terms of execution or poor-quality execution of control documents with a copy of the enforcement order.

53. The head of the administration on the facts of gross violations of the requirements of this Regulation, including the procedure for executing control documents, may make an offer to the akim of the region to bring the guilty official to justice.

54. In cases of untimely execution, poor performance, as well as replacement of the term of execution of control documents of higher bodies, acts of akimat and akim of the region , instructions of the region akim, executive discipline is considered at a meeting of the operational council with the participation of the first heads of state bodies.

 

7. Final Provisions

55. The deputies the region akim, the head of the region akim's administration and his deputies ensure control over observance of the requirements of this Regulation.
